Father is ready to turn page on Utah adoption horror story

A 4th District Court judge says he is “astonished and deeply troubled” by a Utah adoption agency’s deliberate move to circumvent the rights of a married man whose daughter was adopted at birth without his knowledge.

The Provo judge, while noting the birth mother had deceived her husband, the adoption agency and the prospective parents, has given the adoptive couple 60 days to give the child back.

In a 48-page ruling, Judge Darold McDade said the Adoption Center of Choice’s policy of refusing to disclose any information to Terry Achane once he learned what had happened to his baby is “utterly indefensible.”

    This is another seriously disturbing story coming from Utah. Check out the Frei’s blog @ frei-adoption.com if you want an example of the worst type of adoptive parent. How they can justify keeping a child from her rightful and loving family is beyond me. And even with this ruling is sounds like they will get to keep Teleah during the appeal…then we all know what will happen…there will be screams of “but you can’t take her from the only family she’s ever known!”

    Paige – it disturbs me no end using the “you can’t take her from the only family she’s ever known”…or…”ripped from the arms of loving adoptive parents”…

    As to the petition that he “abandoned” the mother – he was transferred while serving his country…how on earth that could be abandoned is anyone’s guess.

    Just can’t stomach too much more of these cases…perhaps, just perhaps, all those pro-adoption-whatever-it-takes folks will finally wake up and smell the coffee and get serious about what adoption really should be.

    Seems I am on a roll with old phrases today – already use knickers in a knot else…sigh…need more coffee.

      Not only that, but he had the mother on his insurance, paid the mortgage on the house she was living in, gave her money, etc. Everything a responsible parent does for the welfare of their child.

    If this judge is ‘astonished and deeply disturbed’ just now, well he really hasn’t been paying attention.
    This is happening all over the country.
    The tactics that adoption agencies use (obtaining consent under fraud/duress) and then the battle that the natural parents face to prove it and get their child back is all part of how many adoption ‘professionals’ ‘play the game’, because after all isn’t possession 9/10 of the law?
    Check out this case….this one is in FL. The agency worker waited for the mother to leave the hospital with her son after the mother told them (and the couple hoping to adopt) that she had decided to parent. The agency owner denied the mother’s request to consult with an attorney and then proceeded to ‘hotbox’ her for over two hours in the hospital parking lot to sign consent until she broke.
    This woman needs an attorney.
    The agency and couple have obtained representation of a 30 year adoption attorney who owns two agencies, and they have already begun playing the game of ‘keep away’, taking depositions that are discovering nothing, delaying the emergency hearing to contest the adoption. Paperwork was filed to request an emergency hearing approx. two weeks after the hospital parking lot. The child will be 3 months old this week, and there still is no court date.

    Do you have any idea if there’s a fund for Mr. Achane’s legal fees that people can contribute to?

      Veggiemom – I don’t know if a fund has been set up for Mr. Archane’s legal fees but what a GREAT idea. This is his lawyer who would be able to answer that question.
